Let’s say an individual is being sued by a finance corporation. The supposed individual never received notification/correspondence from the plaintiff of the pending suit. No summons has even been served, even though the attorney defending the plantiff states it was (has yet to furnish proof). In fact, the only notification received was a postcard from the court indicating a default judgment has been entered, weeks after the fact! The attorney for the plaintiff claimed they didn’t have a correct address for the defendant until after the suit was filed, but still, no summons was actually served.
Would this individual have entitlement to seek damages? What recourse is available?
